To evict a tenant in the State of California an unlawful detainer process must be engaged on behalf of the property owner and a lawsuit filed in superior court. An unlawful detainer lawsuit is a "summary" court procedure. This means that the court action moves forward relatively quickly and that the time given the tenant to respond during the lawsuit is also relatively short. The landlord must use this court process to evict the tenant and cannot resort to self-help measures.
While it is often the last resort to evict a tenant, the process should be initiated and managed professionally within the legal boundaries of the State of California real estate law. Further, it can be a time consuming and stressful process necessitating confidence in the company providing the eviction services.
